ART NEIGHBOR RULES and POLICIES
This section outlines thegeneral Rules and Policies of being a member of the Art Neighbor (AN) community. AN was created to bring together people who share a love of all things Art & Collectible. As a member of AN you are expected to treat others with courtesy and respect at all times. While we highly value each and every member, we will not tolerate disrespectful or malicious behavior.
The AN Marketplace is a very unique place to buy and sell Art & Collectibles and we want to make it a safe and enjoyable place to do business. We welcome everyone to do business on the site. We require all our members to actprofessionally and responsibly at all times. To report a policy violation please click on the 'Report' link located atthe bottom of each page and submit a message, which will automatically contain the page URL. Account/Membership
- When becoming a member of AN, you agree to abide by our Terms of Use and all AN Rules and Policies.
- You must be 18 years of age or older to become a member of the Community and/or to transact business in the Marketplace.
- Members cannot use the term Art Neighbor in their user name without permission.
- Please choose your user name carefully. User names can only be changed in the event of a legal action (such as trademark infringement) and at our discretion.
- You may not use profane, racist, vulgar or explicit language or images anywhere in the public areas of AN. We reserve the right to remove any text or images at any time and without notice.
- You may not post inaccurate, false, misleading, defamatory, or libelous content.
- You are responsible for everything you say and do, and all content submitted under your user name.
- You are not allowed to use the public areas of the site to discuss or air disputes with other members. If you are unhappy with a transaction you can give a buyer or seller a negative rating. We encourage buyers and sellers to resolve their own disputes, as we cannot act as mediators between members or other parties.
- You cannot use separate accounts to deceive or cause harm to another party.
- You may not use an account to solicit or redirect traffic to another web location.
- You may not post links or URL's (or any other information) that direct shoppers to another website to purchase the same item(s) as those listed on AN. We view this as fee avoidance, which could lead to a review and possible suspension of site privileges and/or termination of your account(s).
- Members are prohibited from transferring their account and user ID to another party without our consent.
- Members who have multiple accounts can in no way combine them or transfer information from one account to another.
- Members must always keep a valid emailaddress attached to their account. We will use this address to contact youif and when necessary.
- Members must not post content or items inincorrect or inappropriate areas or categories.
- AN reserves the right to cancel anyaccount that has remained inactive for a long period of time.
- You can delete your account at any time by goingto the link called 'Delete Account' on your dashboard. Your profile andall personal information will be permanently removed from the site.
- Any member that fails to comply with our Rules and Policies will be subject to review and possible suspension or terminationof account privileges and/or membership.
Without limiting other remedies, Art Neighbor reservesthe right to modify or discontinue services (or any part thereof) with or without notice, all accounts and user names of any member who does not comply with Art Neighbor Rules and Policies. Suspended or terminated members remain obligated to pay all unpaid fees. For more detailed information please see our Terms of Use, FAQ's, and Buying and Selling instructions.
Email/Chat
- AN's email/chat system may not be used toknowingly harass or abuse another member. Members should treat otherwith courtesy and respect at all times.
- Members must comply with another members requestthat they not contact them, whether through email, chat, or any other means.
- AN email/chat (or any other area of AN) may notbe used to distribute or post spam, unsolicited advertising orpromotions, bulk electronic communications, requests for donations, chainletters, or donations.
- When opting out of receiving AN emails, you will still receive important service announcements and other essential announcements.
- Members must always keep a valid emailaddress attached to their account. We will use this address to contact youif and when necessary (please make sure you are receiving our emails by keeping your email current and adding Art Neighbor to your safe list and/or addressbook).
Marketplace/Transactions
Art Neighbor (AN) was designed to make the buying and selling of Art and Collectibles safe, easy, and enjoyable. We offer buyers several purchasing and payment options, all of which help to alleviate the fear and apprehensionassociated with buying expensive goods online. Sellers also have severallisting and transaction options to help ensure safety and add convenience.
Our unique seven-calendar day "Out on Approval" system gives buyers the luxury of inspecting purchases before payment is released to the seller, and applies to any item purchased for $2,000 or more. For your security and peaceof mind, AN has partnered with Safefunds.com,an online escrow service that enables safe transactions. Through the AN "Out onApproval" system, Safefunds collects money from buyers and acts as escrow. Sellers can have the option of using the Safefunds 'item verification' service(additional fees apply when choosing to utilize this service). Please see our Buying and Selling Instructions for more information.
To verify identity, all sellers must register with a valid credit card and email address. If planning to list and/or sell items for less than $2,000, aseller must have a PayPal account, which enables them to accept credit cardpayment directly from sellers. Please see our Buying Instructions . When buying on AN we offer several purchasing and payment options, as well as the ability (if made available by the seller) to negotiate price by using our "Make an Offer" system. AN has designed a messaging system that allows buyers and sellers to make bids and counter-offers with the click of a mouse (please see Buying and Selling instructions for more information).
Regardless of the transaction method, we strongly encourage buyers and sellersto keep an open line of communication at all times. Buyers and sellers can communicate freely through the AN mail system or chat, and should always work together to resolve any issues should they arise. Buyers and sellers should also be diligent in leaving honest and accurate feedback. For more informationregarding the buying and selling process please read our Buying Instructions and Selling Instructions, as well as our Buying & Selling FAQ's. Please be aware that PayPal, Safefunds, and other services used to complete transactions may have different policies then AN regarding transactions.
General Rules and Policies
- You must be at least 18 years of age to become a member and/or transact business on AN.
- You must be a registered member to participate in the AN Community and to buy and sell items in our Marketplace.
- Members cannot transact business on AN if they are unable (for any reason) to form legally binding contracts.
- Members should never suggest, or ask another member, to buy or sell an item listed in the AN Marketplace outside of the AN Marketplace. This could be a scam or constitute an attempt to avoid AN fees.
- Users may not engage in fee avoidance bytrying to circumvent or manipulate our fee structure, billing process, or fees owed to AN.
- Users may not manipulate the price of any item or interfere with other users listings.
- You may not suggest to another member 'involved' in a transaction not do business with a particular buyer or seller.
- Sellers receive payment for their solditems according to the terms listed in our Selling Instructions.
- You must never encourage or enable others to infringe upon any copyright trademarks, or intellectual property rights of any third parties.
Buyer Rules and Policies
Following is a list of our buying Rules and Policies. You can find more details by reading the rest of the Rules and Policies pages and by referencing Art Neighbor (AN) Buying Instructions, Buyer FAQ's, and Terms of Use.
- All buyers must be registered members of AN. As a member you can participate in our vibrant Community and buy and sell items in the AN Marketplace.
- Buyers pay no premiums or commissions.
- You must submit valid information to the seller and/or AN pertaining to shipping, billing and payment.
- You may contact the seller by clicking onthe "Ask the Seller a Question" button next to the item being sold, or by going to the sellers profile and clicking on "Send Message."
- You must pay the seller directly for any itemcosting under $2,000.
- When buying directly from a seller, youmust pay for the item at the time the transaction is created. Credit card payments are made through Paypal, and you can do so with or without having a PayPal account. Using PayPal is optional 'if' the seller accepts personal checks and/or money orders. If paying by mail you should contact the sellerthrough AN mail or chat to work out the details.
- For your protection, all items costing $2,000 or more are purchased via the Safefunds escrow service (please see our Buying Instruction for more information.
- When purchasing any Art & Collectibleitem costing $2,000 or more you automatically get to use the AN "Out on Approval" system, whereby a buyer can inspect a purchase before payment is released to a seller.
- You must first open an account with Safefunds to purchase an item of $2,000 or more. Opening an account with Safefunds is easy, and we provide a direct link to them each time you create a new transaction.
- When purchasing an item through Safefunds, buyers must remit payment within five business days of creating a transaction, or it is considered void.
- Sellers have the option (at their own expense) to use the Safefunds 'item verification' service. The AN "Out on Approval" system still applies.
- Items sold via the Safefunds 'item verification' service will not have a separate charge listed for shipping. The listing price of these items includes the cost of delivery.
- After receiving an item, you should go toyour 'items pending' page to confirm that your purchase has been delivered.
- Items purchased via the "Out on Approval" systemor Safefunds.com can be returned fora full-refund (for any reason), as long as you inform us of your intention to do so within seven-calendar days of receiving an item (see Buying Instructions for more info.).
- To notify us of your intention to return a purchase, either email us at returns@artneighbor.com, or go into your AN account and click on deny purchase (located under 'My Marketplace' on your dashboard).
- You should always obtain a tracking number and get delivery confirmation when shipping a returned item. Sellers willalso be providing us with a tracking number and courier name to track deliveries
- Buyers are responsible for return shipping expenses unless a seller has grossly misrepresented or 'delivered' a damaged item. In such cases, return shipping costs revert back to the seller.
- When using the AN "Out on Approval" service youhave fifteen days to return an item. You are no longer eligible to return an item if shipping is not initiated within 15 calendar days. A valid tracking number must be provided to AN.
- When returning an item purchased via the AN "Out on Approval" system or Safefunds, refunds are issued only after we obtain verification that your item has been properly returned to the seller.
- If you bid (or counter-offer) for an item through the "Make an Offer" system, you should honor your offer for atleast 24 hours. All seller offers are good for a minimum of 24 hours.
- You must always leave honest and accurate seller feedback.
Members who violate any of these policies may be subjectto review. Without limiting other remedies, Art Neighbor reserves the right tomodify or discontinue services (or any part thereof) with or without notice,all accounts and usernames of any member who does not comply with Art Neighbor Rulesand Policies. SellerRules and Policies
Following is a list of our selling Rules and Policies. You can find more details by reading the rest of the Rules and Policies pages and by referencing Art Neighbor (AN) Selling Instructions, Selling FAQ's,and Terms of Use.
- You must have a valid credit card and email address to register as a seller. This information verifies your identity and allows us to stay in contact with you.
- You must have a PayPal account if you plan on listing and/or selling any items below $2,000. PayPal enables sellers to accept credit card payments and pay AN fees.
- There are no listing fees on AN. We only collect fees on sold items. For a list of fees, please see our Selling Instructions.
- You can remove, change, or edit your listing at any time. However, once a buyer pays you for your item, you must deliver it promptly.
- You should only post photos of your listing that are clear and of high quality.
- You may not list the same item in morethan one account and each unique item requires its own listing.
- You must describe the item in your listing accurately. Not doing so can lead to the item being returned and negative feedback. Repeat offenders face account review by AN, which can lead to suspension of privileges or termination.
- Sellers need to always keep an open line of communication and act professionally and courteously with buyers.
- You have the option to accept money orders and/or personal checks from buyers paying you directly (applicable only to sales of less than $2,000).
- Sellers have the option to list any item with a "Make an Offer" sign next to it. For more information on using "Make an Offer" please see AN Buying Instructions.
- When electing to offer our "Make an Offer" system you agree to honor all offers for at least 24 hours (or until a buyer declines your offer). Once you and a buyer come to an agreement on price, the buyer must arrange payment within 24 hours or the transaction is void and you can accept other offers.
- As a seller you agree to abide by the AN fee and payment structure.
- When selling any item for $2,000 or more, you agree to abide by our seven-calendar day AN "Out on Approval" system, whereby buyers have the opportunity to inspect their purchases (using escrow) before payment is released (please see Selling Instructions for more info).
- Sellers have the option of using the Safefunds "item verification" service on any transaction of $2,000 or more. Additional fees apply when choosing to utilize this service. Please see AN Selling Instructions and/or www.safefunds.com/verification.html for more information.
- When selling an item through the Safefunds.comescrow service, you agree to allow AN to act on your behalf.
- A seller should never open a Safefunds account to sell an item listed on Art Neighbor.This would constitute fee avoidance and could lead to suspension of privileges and/or account termination.
- When selling an item through Safefunds and the AN "Out on Approval" system, never initiate shipping until we have informed you that payment has been collected.
- You must deliver items purchased from buyers, unless the buyer fails to meet the posted terms, or the buyer's identity cannot be authenticated.
- Upon shipping an item you must enter a courier name and tracking number, which can be entered on the 'items pending page' located under the My Marketplace link of your dashboard. This information allows us to monitor your package (including when and if your item was received) and answer buyer inquiries.
- You must ship items (once payment has been collected) within a reasonable amount of time (within seven calendar days, unless extenuating circumstance exists) to the address submitted by the buyer. If selling through the Safefunds 'item verification' service, shipping to Safefunds should be done with seven calendar days.
- You should always obtain a tracking number and get delivery confirmation (especially for expensive items) when shipping ani tem.
- Buyers are responsible for all return shipping expenses associated with returns, "unless" you have grossly misrepresented or delivered a damaged item (see Selling Instructions for more info).
- If you have misrepresented an item or it is delivered damaged, you agree to pay (and relieve the buyer from paying) all returnshipping expenses.
- You are not held responsible for: shipping service errors or delays; customs delays; or theft.
- You may not purchase or act as a purchaser of your own items using different accounts. This is called "shilling." AN will not issue refunds for erroneous or accidental activity caused by multiple account ownership.
- You may not ask a member to buy an itemlisted on AN outside of the AN marketplace. This may constitute fee avoidanceand could lead to suspension of privileges and/or account termination.
- You may not cancel a transaction for the purpose of avoiding fees or feedback.
- You may act in any way to avoid paying AN fees.
- You can refuse service to a particular buyer, but must do so prior to shipping an item. If the buyer has already paid,then you must refund the entire amount paid (including shipping). You must notify the seller of your refusal of service through AN mail or chat.
- You must always leave honest and accurate buyer feedback.
- AN reserves the right to question and/or requestthat a seller modify or desist from any selling procedures we feel are unreasonable or in bad taste.
- You must pay all AN fees on time. Sellerswho do not pay fees on time may have their selling privileges suspended and/or terminated. Please see our Selling Instructions for more information.
Members who violate any of these policies may be subject to review. Feedback Rules and Policies
Whether buying or selling an item, we ask that you leavefeedback that reflects your experience with a buyer or seller. Leaving honest and accurate feedback is very important to the member being rated and to others who shop on AN. It helps other members by giving them an idea of what to expect when dealing with a particular member. It's also a good way for you to express your appreciation by helping buyers and sellers establish a reputation of trust. To leave feedback, please go to the 'items sold' page listed under 'My Marketplace' in your dashboard and click on the link to leave feedback. Each transaction can be rated as either: positive, neutral or negative. Also, there is an optional comment box that allows a 140 character description of the transaction. Buyers and sellers have 60 days from the date of the transaction to submit feedback. If a buyer or seller receives a neutral or negative feedback, they can request a change to positive by clicking on the "SecondChance" link located next to each feedback entry. When sending a Second Chance offer, an email will automatically be sent to both buyer and seller. Bothparties must approve the change for it to take effect.
When submitting feedback, always provide an honest and accurate assessment. Here are a few Rules and Policies regarding feedback:
- Users may not act in any way that could undermine the Feedback or ratings system (for example, using the information for reasons not pertaining to AN).
- We expect every member to leave honest and accurate feedback.
- Sellers with a low feedback score may be subject to review, which could lead to account suspension and/or termination
- The option to leave feedback expires after 60 days.
- Once positive feedback is submitted it cannot be edited or removed.
- Negative or neutral feedback ratings can be changed to positive only by using the "Second Chance" feature. Here's how it works: If a buyer or seller receives a neutral or negative feedback, they can request a change to positive by clicking on the "Second Chance" link located next to each feedback entry. When sending a Second Chance offer, an email will automatically be sent to both buyer and seller. Both parties must approve the change for it to take effect.
Art Neighbor reserves the right to remove or alter feedback at its discretion, at any time, and without notice to either party. Members may send a request to have feedback removed. We do not investigate the validity or mediate feedback disputes. However, AN will remove feedback comments and/or ratings due to the following:
- Profane, racist, vulgar or explicit language or images.
- Links, advertising or spam is left in the comment box.
- Feedback was mistakenly submitted for a different transaction.
- Feedback refers to an unrelated transaction and/or experience.
- Negative statements or images conflict with a positive rating.
- Personally identifying and/or private information is displayed about a person or business, including real name,physical or email address, phone number, details of an AN investigation, or the content of a private message posted on AN.
- Reference is made to Art Neighbor or PayPal investigations.
- Feedback for a transaction solely created for leaving feedback, and/or feedback left from the same person using separate accounts.
- Defamatory or neutral comments referring to ArtNeighbor or other unrelated services or companies.
- When a member is suspended all their negative or neutral feedback is removed.
- Art Neighbor is provided with a valid courtorder requesting feedback removal.
Members who violate any of these policies may be subject to review. Without limiting other remedies, Art Neighbor reserves the right to modify or discontinue services (or any part thereof) with or without notice,all accounts and user names of any member who does not comply with Art Neighbor Rules and Policies. Dispute Rules and Policies
We have attempted (and will continue to work) to create the most satisfying shopping experience possible on Art Neighbor (AN). Unfortunately, transaction disputes do occur and we want to do everything possible to ensure disputes are settled properly. First and foremost, we strongly encourage sellers to providea clear and open line of communication at all times. Buyers and sellers should always try to work out their differences before filing a dispute (disputes@artneighbor.com). Buyers and sellers can communicate freely through the AN mail system or through chat.Although we will always try our best to resolve disputes, we cannot act as a mediator.
All items selling for $2,000 or more are transacted through Safefunds, and subject to their dispute Rules and Policies in conjunction with AN Rules and Policies. Safefunds has an excellent dispute resolution department, and will handle all disputes between buyers and sellers (see www.safefunds.com/terms.html).
For more information please see our Terms of Use. To aid both buyers and sellers, always be diligent in providing honest and accurate feedback. Below is an explanation of our Rules and Policies regarding various transaction disputes.
Failure to deliver occurs when a seller fails to ship an item that a buyer has paid for. There may be a number of valid reasons (item is lost or stolen, etc.) why an item was not delivered. Buyers and sellers should always attempt to resolve delivery issues through communication on AN mail and/or chat. If a situation cannot be resolved, the buyer should contact disputes@artneighbor.com. Sellers and buyers must provide a valid tracking number to resolve disputes. We recommend getting delivery and/or signature confirmation (especially forexpensive items) before shipping an item. All Safefunds transaction disputesare handled by Safefunds.
The following Rules and Policies apply regarding failure to deliver:
- Unless extenuating circumstances exist, sellers should always ship items within a reasonable amount of time (no more than seven days) of receiving payment.
- When using the "Out on Approval" system and Safefunds, a buyer can request a full-refund if a seller fails to initiate delivery of an item within seven calendar days of payment being 'collected' (sellers are notified to ship items only after payment has cleared).
- If an item is purchased through PayPal, buyers can file a non-receipt claim with them.
- If a buyer has paid for an item and the seller cannot complete the transaction (for any reason), the seller must issue the buyer a full-refund (including shipping).
- Buyers should contact disputes@artneighbor.com to request a non-delivery investigation on all non-Safefunds transactions. Sellers must respond to all non-delivery inquiries promptly and may be asked to provide proof of delivery.
- In the event of a dispute, sellers may be required to provide Safefunds or AN with proof that an item was shipped.
- A seller who fails to respond to inquiries tosettle disputed transactions, or who fails to deliver a paid item, may be suspended or terminated.
Failure to make payment occurs when a buyer creates a transaction,but fails to remit payment. This can happen for any number of reasons. When selling directly to a buyer, a seller should never ship an item until payment has been collected. When selling an item through the "Out on Approval" system and Safefunds, sellers should only ship items 'after' receiving notification from AN that payment has been collected.
- When a buyer creates a transaction, he or she should have every intention (and be able) to complete it.
- A transaction is considered void if a buyer fails to pay in the amount of time required for the transaction (see Buying Instruction-Payment Terms).
- A buyer must pay according to the terms of the transaction method chosen (see Buying Instruction-Payment Terms).
- A seller may cancel a transaction if: a)a buyer fails to pay, b) a buyer fails to pay in the amount of time required, c) he or she refuses to do business with the buyer for any reason (if already paid, the seller must refund the buyer for the full price of the item plus shipping).

Additional Art Neighbor DisputeRules and Policies:
- A seller can refuse service to a particular buyer, but must do so prior to shipping an item. If the buyer has already paid,then the seller must refund the entire amount paid (including shipping). You must notify the seller of your refusal of service through AN mail or chat.
- A seller must refund a buyer for any item not received, even if the item was shipped. We strongly suggest sellers obtain tracking information and delivery confirmation when shipping items.
- A seller must refund a buyer if a delivered itemis significantly different than its description on the listing page.
- If a buyer and seller mutually agree to cancel a transaction, all monies paid must be refunded (including shipping, if the itemhas not yet shipped).
- Upon request, both buyers and sellers must comply with any request by AN or Safefunds, to provide documents (proof of shipping or other).
Resolving Disputes:
Art Neighbor (AN) will always help to try and resolve transaction disputes,however, we cannot act as a mediator. Besides contacting us to help resolve a dispute, members should be aware of a few additional options:
- If a dispute arises with a transaction done through PayPal, you can file a dispute and/or make a claim with them (www.paypal.com).
- If a transaction is done through Safefunds, they will handle the dispute through their dispute system, designed to protect both buyers and sellers (www.safefunds.com).
Members who violate any of these policies may be subject to review. Listings Rules and Policies
As a seller, it is important to list items with a clear and concise title and accurate tags, so buyers can easily find them. An accurate description and high-quality photo's are critical to helping your item sell and help to remove any discrepancies as to what you are offering. Following is a summary of ourlisting Rules and Policies:
- All sellers must register with a valid credit card and email address to verify their identity, in order to deter fraudulent sellers from listing on AN.
- You can list an item for 90 days or 'until it is removed or sold,' and you can remove a listing at any time without penalty. However, once a buyer pays you for your item, you must deliver it promptly.
- You must only list items that you are willing and able to sell.
- All items listed for less than $300 will automatically be listed in the under $300 Marketplace.
- No item can listed or sold for under $20
- You may not list the same item in more than one account and each unique item must have its own listing.
- Any seller listing an item under $2,000 must have a PayPal account (allows buyers to pay via credit card and sellers to pay AN fees).
- Sellers have the option to list any item with "Make an Offer" attached to it. For more information on using "Make an Offer" please see AN Buying Instructions.
- When offering (or counter-offering) an item to a seller through the "Make an Offer" system, you must honor the price for a minimum of 24 hours, or until the buyer declines purchase. Once you and abuyer have agreed on price, the buyer must create a transaction within 24hours. If not, you can entertain other offers.
- You should list your item at a reasonable price. We recommend that sellers list items below retail. You should list your item at prices that reflect both current market conditions and a good value for your particular item.
- You should assign a fair and reasonable shipping cost on all items.
- When listing an item with a value of $2,000 or more, you have the option (for your protection) of using the Safefunds "item verification" system. Additional fees apply. Please see our Selling Instruction and/or www.safefunds.com/verification.html for more information.
- When listing an item to be sold through the Safefunds 'item verification' service, there are no shipping fees assigned and sellers are responsible for shipping costs (see Seller instruction for more information).
- When listing any item for $2,000 or more you agree to abide by our seven calendar day "Out on Approval" system (please see Selling Instructions).
- When listing any item for $2,000 or more, you agree to let buyers pay via Safefunds, and to let Art Neighbor act on your behalf (please see Selling Instructions).
- A seller should never open a Safefunds account to sell an item listed on Art Neighbor. This would constitute fee avoidance and could lead to suspension of privileges and/or account termination
- You have the option to accept money orders and/or personal checks when getting paid directly from sellers (only eligible for items selling under $2,000).
- You cannot list any item found on our restricted item list (see below), which includes anything that cannot be considered an Art or Collectible.
- You are required to describe the item in your listing accurately and list all condition flaws. Not doing so can lead to negative feedback and/or account review by AN (In most cases, unless grossly misrepresented, buyer's will almost always approved purchases done through escrow).
- Any item grossly misrepresented by a seller will entitle the buyer to a full-refund (including shipping).
- We suggest that sellers supply multiple photos. This will aid buyers and make them more likely to purchase your item. You can show up to five pictures of any item.
- If you are selling original artwork (especially older art), it helps to show pictures of the signature and the back for the painting.
- QUALITY PHOTOS WILL HELP YOUR ITEM SELL! Please make sure your photos are clear and of high quality before posting them in the Marketplace. Items listed with poor picture quality will be removed from the Marketplace. All photos must be a minimum of 400 x 400 pixels in size to be accepted in the Marketplace.
- You can refuse service to a particular buyer, but must do so prior to shipping an item. If the buyer has already paid, then you must refund the entire amount paid (including shipping). You must notify the seller of your refusal of service through AN mail or chat.
- You may not use profane, racist, vulgar or explicit language or images anywhere in the public areas of the Marketplace. We reserve the right to remove any language and/or images at any time and without notice.
- You must never make illegal use of writtentext or photographs. This violates our Terms of Use
- When listing an item you agree to abide by our feeand payment structure, and all AN Rules and Policies (see Selling Instructions).
- You may not post links or URL's (or any other information) that direct shoppers to another website to purchase the same item(s) as those listed on AN. We view this as fee avoidance, which could lead to a review and possible suspension of site privileges and/or termination of your account(s).
- You may not offer items for rent or lease.
- A listing cannot be changed to reflect anentirely different item.
- You cannot offer gift certificates of any kind.
- When listing an item as an original it mustbe signed by the creator and/or have an opinion from a respectable person ororganization.
- You may not post any listings that havethe potential of violating any copyright, patent trademark, trade secret orother proprietary right of any individual or entity. Please see our Terms of Use for more information.
- Art Neighbor reserves the right to remove any listing for any reason and without comment.

Selling Fees:
To list an item there are no membership or listing fees. In addition, AN does not charge commission on shipping and there are no additional service fees.
Direct Payment: Buyers pay sellers directly for all purchases under $2,000. For all items paid for directly, AN will bill sellers 5.0% of the net purchase price ($5 minimum) at the beginning of each calendar month.
Safefunds Escrow: Any item selling for $2,000 or more must be purchased through the Safefunds.com escrow service. When selling through Safefunds, sellers will receive the sales price of their item less 7.5% of the net selling price (includes all Safefunds and AN fees).
Safefunds Escrow "Item Verification:" Sellers have the option of using this service for any transaction of $2,000 or more. When selling through Safefunds 'item verification', sellers will receive the sales price of their item less: 1) 9.5% of the net purchase price (includes all Safefunds and AN fees, and 2) the cost of having Safefunds ship their item to the buyer.

Prohibited Items
Before listing any item, make sure it is allowed on ArtNeighbor. In general, an item must be considered art and/or a collectible to be sold on AN. Below is a list of prohibited and restricted items. Although some prohibited and restricted items could be considered collectibles, they still cannot be listed on AN. Sellers should also make sure that the items they list comply with all other laws (including local, state, federal, etc.).
- Alcohol
- Animals, illegal animal products
- Anything that cannot be considered an Art or Collectible item
- Counterfeit currency and stamps
- Drugs, drug paraphernalia, drug-like substances
- Embargoed goods and goods from prohibited countries
- Ethnically or racially offensive material (for example Nazi memorabilia)
- Firearms, weapons, and knives
- Forgeries of any kind
- Hazardous Materials and Pesticides
- Human Parts and Remains
- Items that are ethnically or racially offensive and/or promote hatred
- Items that encourage or instruct other to engage in illegal activity
- Items that infringe upon any copyright trademarks, or intellectual property rights of any third parties (please see our Terms of Use for more information)
- Mailing lists and personal information
- Real Estate
- Recalled items (please see cpsc.gov for a list of recalled items)
- Stolen Property and property with removed serial numbers
Sellers may not list (or ship) any items that violate local,state and federal laws (please see our Terms of Use for more information). Members that list prohibited items will have them removed from the site, and may have their account privileges suspended and/or terminated.

CONTEST RULES & POLICIES
We hope you enjoy our contests. It is a great way to get noticed and earn a little side money. The following rules apply:
- You must be a member to enter a contest.
- You must be a member to vote on a contest.
- Each contest will have its own criteria for submitting entries. Only entries that adhere to the criteria are eligible to enter.
- Each member is limited to one entry.
- Each entry must be an original created by the member submitting the work.
- Every contest will have finalists chosen by the Art Neighbor staff.
- The finalists will have their entries posted and members of Art Neighbor will vote to determine the winner.
- Each member is limited to one vote.
- There will be one winner.
- Each contest winner will:
1) Win a cash price (to be announced before each contest)
2) Become the "Featured Artist" on the home page (must have a detailed profile to be eligible)
3) Have their winning entry automatically entered into the Art Neighbor Museum
4) Be featured on the Museum home page
5) Get a "Contest Winner"sign put next to their name in the artist directory.
- To verify that the winning piece was done by the member who submitted it, the winner must provide us with the following:
1) A picture that shows (conclusively) their name signed on the winning entry.
2) A picture of them holding the winning entry.
- In the event a winner is disqualified, the second place finisher will be awarded first prize. If the second place winner is disqualified, then the third place winner will be awarded first prize.
